1. Parties
1.1 LEARNIEE URJA (“Learniee Urja”), by Urja Talents which owns and operates the website located at www.learnieeurja.com (the “Website”). The Website is an online education platform that offers online courses, tutorials and other educational resources.
1.2 Any individual who visits or otherwise uses or interacts with the Website (“User” or “You”).
2. Background
2.1 LEARNIEE URJA owns and operates the Website located at www.learniee.com, which is an online education platform that offers online courses, tutorials and other educational resources to Users.
2.2 In order to use certain features and functionalities of the Website, Users are required to provide certain personal information including name, email address, location, payment information, educational qualifications and other details.
2.3 This Privacy Policy sets out LEARNIEE URJA’s policy on the collection and use of personal information collected from Users on the Website. The purpose of this Privacy Policy is to explain to Users what personal information is collected, how it is used, and the rights of Users with respect to their personal information.
2.4 This Privacy Policy and LEARNIEE URJA’s information handling practices comply with applicable data protection laws of India.

3. Definitions
3.1 Company means LEARNIEE URJA.

3.9 “Educators” are independent contractors – either individuals or organizations – who offer classes through Learniee’s platform.
3.10 “Services” refer to our online marketplace for education and engagement through Learniee’s platform, including our website(s), application(s), device(s), and other products and offerings, such as classes and activities.
3.11 “Classes” means the courses developed/taught by Educators, whether individuals or organizations.
3.12 Third Party means any individual or entity other than the User or the Company.
4. Collection of Personal Information
4.1 Information collected. LEARNIEE URJA collects the following personal information from Users:
4.1.1 Name, email address, phone number and location provided during registration for an account on the Website.
4.1.2 Educational qualifications, courses enrolled, payment details and other transaction related information provided while availing services offered on the Website.
4.1.3 Video recordings which include all videographic content recorded during the lecture, such video recordings shall contain videos of Children, Educators and content delivered/published by the Educator.
4.2 Collection methods. Personal information is collected:
4.2.1 When voluntarily provided by the User through online forms, registration for an account or purchase of courses on the Website.
4.2.2 Automatically through use of cookies while browsing the Website. Cookies are small text files placed on a User’s device which identify the User’s browser or device and collect information such as IP address, browser type and settings, the date and time of visits and the pages viewed directly prior to and following visits to the Website.
4.3 Purpose of collection. Personal information is collected for the following purposes:
4.3.1 To provide the courses and educational services requested by the User.
4.3.2 To communicate with the User regarding courses, updates, promotions and other matters relating to the services offered on the Website.
4.3.3 To generate analytics and insights to improve the Website user experience and offerings.
4.3.4 To comply with applicable laws.
4.4 Consent. Collection of personal information is done with the prior opt-in consent of the User which may be withdrawn at any time by contacting LEARNIEE URJA through the contact details provided on the Website.
4.5 Children’s information. Additional consent will be required as per applicable laws for collection of personal information from children below 18 years of age.
5. Use of Personal Information
5.1 The Company will only use Personal Information for the purposes for which it was collected, namely:
5.1.1 To provide the services offered on the Website to Users.
5.1.2 To communicate with Users and respond to any queries raised by them.
5.1.3 To conduct direct marketing activities via email or other communication channels. Users have the option to opt-out of receiving such direct marketing communications.

8.4 Upon receipt of a verifiable request from a User, the Company will correct or update the Personal Information within 30 days.
8.5 Exceptions. The Company may reject requests that are excessive, require disproportionate technical effort, or adversely affect others’ privacy.
8.6 The Company is not required to provide access to Personal Information which relates to existing or anticipated legal proceedings.
8.7 Fees. The Company may charge a reasonable fee to cover the administrative costs of providing the Personal Information to a User on multiple occasions.
9. Retention of Personal Information
9.1 The Company will retain Users’ personal information for as long as necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law.
9.2 The Company may retain personal information for a longer period whenever:
9.2.1 The personal information is necessary in relation to any ongoing or prospective legal proceedings;
9.2.2 The personal information is necessary for the purposes of establishing, exercising or defending any legal claims; or
9.2.3 Applicable laws require a longer retention period.
9.3 The Company may continue to retain their personal information to prevent fraud, or for the establishment, exercise or defense of legal claims.
9.4 The Company may retain indefinitely any non-personal information that has been anonymized. Anonymized data does not constitute personal information and is not subject to erasure.

12. Children’s Privacy
12.1 If LEARNIEE URJA learns that it has inadvertently received personal information from a child without parental consent, it will delete such information from its records.
12.2 LEARNIEE URJA complies with the safe harbor principles for collection, use and retention of personal information from children as set out by the Ministry of Electronics and Information Technology.
12.3 LEARNIEE URJA will notify parents and obtain verifiable parental consent before changing its policy relating to collection, use and disclosure of children’s personal information.
13. Changes to this Privacy Policy
13.1 LEARNIEE URJA reserves the right to amend this Privacy Policy from time to time at its sole discretion.
13.2 Users will be notified of any material changes to this Privacy Policy through prominent notice on the Website for a period of 30 (thirty) days.
13.3 The amended Privacy Policy will become effective from the date of its posting on the Website.
13.4 Continued use of the Website after such effective date means that the User agrees and accepts the amended Privacy Policy.
13.5 Notwithstanding anything contained in this Privacy Policy, LEARNIEE URJA shall not be required to provide notice to Users for non-material changes to this Privacy Policy.
14. Governing Law
14.1 This Privacy Policy and any dispute or claim arising out of or in connection with it shall be governed by and construed in accordance with the laws of Mumbai, India.
14.2 The parties irrevocably agree that the courts of Mumbai, India shall have exclusive jurisdiction to settle any dispute or claim.
14.3 In the event of any dispute regarding this Privacy Policy, the parties agree to attempt to resolve the dispute through mutual discussion and negotiation in good faith.
14.4 If the dispute is not resolved within 30 days, the parties agree to submit the dispute to arbitration.
14.5 The arbitration will be conducted in Mumbai, India in accordance with the Arbitration and Conciliation Act, 1996.
14.6 The arbitration proceedings will be conducted in English. The arbitration award shall be final and binding on the parties.
14.7 The courts in Mumbai, India will have exclusive jurisdiction over any appeals against the arbitration award.
